Terms of Service

Please read these Terms and Conditions ("Terms," "Agreement") carefully before using the website and the suite of services provided by MyBizKit LLC ("us," "we," or "our").

1. Acceptance of Terms

By accessing or using our Services, including but not limited to signing up for an account, purchasing a subscription, or utilizing any of our tools, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of the terms, you are prohibited from using the Service.

2. Definitions

  • Company: Refers to MyBizKit LLC.

  • Client ("you"): Refers to the individual or business entity that registers for, subscribes to, or uses our Services.

  •  Services: Refers to the suite of business solutions provided by the Company, including but not limited to Customer Relationship Management (CRM), AI-powered tools, automation workflows, website builder, and other related applications offered as part of our "business kit."

  •  Platform: Refers to the web-based software, applications, and infrastructure through which our Services are delivered.

  •  Subscription: Refers to the specific plan and billing cycle selected by the Client for accessing the Services.

  •  Client Data: Refers to any data, information, content, or materials uploaded or entered into the Platform by the Client in connection with their use of the Services, including customer information, files, and website content.

3. Services and Subscriptions

3.1 Service Provision:

The Company grants the Client a non-exclusive, non-transferable, revocable license to access and use the Services as per their selected Subscription plan, subject to the terms of this Agreement.

3.2 Subscription Plans and Fees:

Services are provided on a subscription basis. The Client agrees to pay all applicable fees associated with their chosen Subscription plan in advance. All fees are quoted in US Dollars unless stated otherwise. Subscription fees are non-refundable except as explicitly stated in this Agreement.

3.3 Service Availability:

We will use commercially reasonable efforts to make the Services available 24/7, except for planned maintenance, emergency maintenance, or any unavailability caused by circumstances beyond our reasonable control (force majeure). We will provide advance notice of planned maintenance where feasible.

3.4 AI and Automated Tools:

Our Services may include features powered by artificial intelligence. While we strive for accuracy, we make no warranty or guarantee as to the accuracy, reliability, or completeness of any output generated by these AI tools. The Client is solely responsible for reviewing, validating, and using any AI-generated content or suggestions in compliance with all applicable laws and ethical standards.

4. Client Responsibilities

4.1 Account Security: The Client is responsible for maintaining the confidentiality of their account credentials (username and password) and for all activities that occur under their account. The Client agrees to notify us immediately of any unauthorized use of their account.

4.2 Data Backup and Ownership: The Client retains all ownership rights to their Client Data. The Client is solely responsible for maintaining backups of their Client Data. While the Company implements security measures to protect Client Data, we are not liable for any loss or corruption of data.

4.3 Acceptable Use: The Client agrees not to use the Services to:

  • Upload, post, or transmit any content that is unlawful, harmful, abusive, or otherwise objectionable.

  • Violate any applicable local, state, national, or international law, including data privacy and protection laws.

  • Infringe upon the intellectual property rights of others.

  • Transmit viruses, malware, or any other malicious code.

4.4 Legal Compliance: The Client is solely responsible for ensuring that their use of the Services, including any websites built or communications sent via the Platform, complies with all applicable laws and regulations (e.g., GDPR, CCPA, CAN-SPAM).

5. Payment and Cancellation

5.1 Billing and Renewal: Subscriptions will automatically renew for successive periods unless the Client cancels their Subscription through their account settings prior to the end of the current billing cycle.

5.2 Cancellation: The Client may cancel their Subscription at any time. Cancellation will take effect at the end of the current paid term. Upon cancellation, the Client's access to the Services will be terminated, and we may delete the Client Data associated with the account in accordance with our data retention policy.

5.3 Fee Changes: We reserve the right to modify our Subscription fees at any time. Any fee changes will be communicated to the Client with at least thirty (30) days' notice and will only apply to subsequent billing cycles.

 6. Limitation of Liability

In no event shall MyBizKit LLC, nor its directors, employees, partners, agents, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

(i) your access to or use of, or inability to access or use, the Service;

(ii) any conduct or content of any third party on the Service;

(iii) any Client Data or content obtained from the Service; and

(iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.

In no event shall MyBizKit LLC's total aggregate liability for all claims related to the Services exceed the total amount paid by the Client to the Company in the twelve (12) months immediately preceding the event giving rise to the claim.

 7. Intellectual Property

The Services, the Platform, and all original content (excluding Client Data), features, and functionality are and will remain the exclusive property of MyBizKit LLC and its licensors. Our trademarks may not be used in connection with any product or service without our prior written consent.

 8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of [Your State, e.g., Delaware], United States, without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of these Terms shall be instituted in the federal or state courts located in South Carolina, USA.
